How Do I File Chapter 13 Bankruptcy?

Short Version

This is what is required to file Chapter 13: 
  • You provide us detailed information about your debts, income and assets along with certain documents like tax returns and wage statements.
    ​

  • We use this information to ensure that you are able to fund a successful Chapter 13 and visit with you about how you want to reorganize your financial affairs.

  • We prepare a number of court required forms for you to review and sign.

  • While we prefer to meet with you in our offices, all of this can be done by phone and mail.

  • You attend a brief online credit counseling course required by the Bankruptcy Court costing $50.

  • You pay $310 in fees required by the Bankruptcy Court.

  • We file your Chapter 13.

  • Typically we like to take a couple of weeks to do all of this and provide you the best result possible but if you have an emergency, we can file your Chapter 13 in a couple of days -- provided you do your part timely.

  • Filing Chapter 13 immediately stops all your creditors in their tracks including foreclosures, repossessions, garnishments and calls from collection agencies against you -- and any co-signers like friends and relatives.

  • You pay nothing to us for legal fees in advance of filing.
     
  • Your legal fees are paid from money that would otherwise go to unsecured creditors like credit card companies and other unsecured creditors.
